Privacy Policy
KYB Corporation and KYB Group companies in Japan (hereinafter referred to as the "KYB Group"), establishes this Privacy Policy (hereinafter referred to as this "Policy") to ensure the proper handling of personal information as an organization in accordance with the Act on the Protection of Personal Information (Act No. 57 of 2003, hereinafter referred to as the "Personal Information Protection Act").

In addition to this Policy, which applies to all of KYB Group's handling of Personal Information, KYB Group has developed the following Privacy Notices that may be applicable to you depending on where you live or where you are located. If the laws and regulations of any of the following jurisdictions apply to you, the applicable following Privacy Notices will also apply in conjunction with this Policy, and the following Privacy Notices will supersede this Policy to the extent that there is any conflict between the terms of the following Privacy Notices and the terms of this Policy.

- Article 1 (Personal Information)
- "Personal Information" refers to "Personal Information" as defined in the Personal Information Protection Law and refers to information about a living individual that can identify the specific individual by name, date of birth, or other description contained in the information, or that contains a personal identification code.

- KYB Group may acquire Personal Information including the following information;

If KYB Group intends to use the Personal Information beyond the scope of the following purposes, KYB Group shall obtain prior consent from the individual in an appropriate manner.

- Article 4 (Purpose of Use of Specified Personal Information)
- KYB Group will use Specified Personal Information (Personal Numbers and Personal Information that includes Personal Numbers) of employees, officers, etc. to the extent necessary to achieve the following purposes of use and permitted by law.
・To perform administrative work related to employment insurance in accordance with the Employment Insurance Law
・To perform administrative work related to health insurance in accordance with the Health Insurance Law

- Article 5 (Provision to Third Parties)
- KYB Group will not provide Personal Information handled by KYB Group to third parties without the prior consent of the individual, except in the following cases
(1)When it is necessary for the protection of the life, body, or property and it is difficult to obtain the consent of the individual.
(2)When it is especially necessary to improve public health or to promote the sound growth of children and it is difficult to obtain the consent of the individual.
(3)When it is necessary to cooperate with a national agency, a local government, or an individual or entity entrusted by either a national agency or local government to execute affairs prescribed by law and obtaining the consent of the individual is likely to impede the execution of such affairs.
(4)When permitted by other laws and regulations.
- Article 6 (Entrustment of Handling of Personal Information)
- KYB Group may outsource all or part of the handling of Personal Information to third parties to the extent necessary to achieve the purposes of use stipulated in Article 3. In such cases, KYB Group will thoroughly examine the eligibility of the consignee, stipulate confidentiality obligations in the contract, and exercise necessary and appropriate supervision over the consignee.

- 1.KYB Group will respond to the following requests in accordance with the Personal Information Protection Law after confirming the identity of the individual in accordance with the prescribed procedures.
(1)Requests for disclosure of Personal Information held by KYB Group or records of provision of Personal Information to third parties, or for notification of the purpose of use of Personal Information
(2)Request for correction, addition or deletion of Personal Information held by KYB Group

- KYB Group may change the contents of this Policy from time to time. The revised Privacy Policy shall become effective when it is notified to you in a manner prescribed by KYB Group or posted on KYB Group website.
- Article 10 (Compliance with Laws, Regulations, Guidelines, etc.)
- KYB Group complies with all applicable Japanese laws, regulations, guidelines, etc. regarding Personal Information in its possession.
- Article 11 (Security Control Measures)
- KYB Group shall take necessary safety measures for the management of Personal Information, including thorough employee training and the development of a management system, to prevent unauthorized access, destruction, alteration, loss, or leakage of Personal Information, as described below.
(1)Formulation of basic policy
In order to ensure the proper handling of Personal Information, KYB Group establishes a basic policy (this Policy) regarding "compliance with related laws and guidelines," and "contact for questions and complaints," etc.(2)Establishment of rules for the handling of Personal Information

A.Your Rights Under the General Data Protection Regulation (GDPR)
- This Notice applies if you are a Kayaba Group data subject who resides or is located in the European Economic Area (“EEA”). We adopt this section to comply with European privacy laws, including the General Data Protection Regulation (“GDPR”). Any terms defined in the GDPR have the same meaning when used in this section.

- Transfer of Information Outside of the EEA
- Our business requires the transfer of your Personal Information to Japan as a Japanese-headquartered company. The European Commission has determined that Japan offers an adequate level of protection. You may review the adequacy decision here.
If we share your Personal Information within the Company or with third parties located outside the European Economic Area to a country where an adequacy decision has not been made, we take steps to ensure that appropriate safeguards are in place to guarantee to the continued protection of your Personal Information, such as by entering into the European Commission’s Standard Contractual Clauses, binding corporate rules, applicable privacy framework, or explicit consent, as needed. - How to Exercise Your Rights Under the GDPR
- If applicable, you may exercise any of your rights under the GDPR by submitting a verifiable data subject request to us by contacting us indicated in our Privacy Policy. You may make a request related to your Personal Information or on behalf of someone for which you have authorization. You must include your full name, email address, and attest to the fact that you are a citizen or resident of the EEA by including your country of citizenship or residence in your request. We may require you to confirm your identity and/or legal standing for the request as well as your residency in the EEA to obtain the information. Please note that we will ask you to verify your identity before responding to such requests, and we may deny your request if we are unable to verify your identity or authority to make the request.
Should you wish to raise a concern about our use of your data (and without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority; however, we hope that we can assist with any queries or concerns you may have about our use of your Personal Information first by contacting us indicated in our Privacy Policy.
B.Your Rights Under the United Kingdom GDPR (UK GDPR)
- If you are based in the United Kingdom, the following provisions also apply:
Our business requires the transfer of your Personal Information to Japan as a Japanese-headquartered company. The UK Information Commissioner’s Office has recognized the adequacy of Japan for personal data transferred to private sector organizations falling within the scope of Japan’s Act on the Protection of Personal Information (“APPI”) and acknowledges the European Commission’s adequacy decision referenced above. You may review additional information relating to the ICO adequacy decision here. If we share your Personal Information within the company or with third parties located outside the United Kingdom where an adequacy decision has not been made, we take steps to ensure that appropriate safeguards are in place to guarantee to the continued protection of your Personal Information, such as by entering into the UK International Data Transfer Agreement or the International Data Transfer Addendum to the European Commission’s Standard Contractual Clauses, adopted by the UK Government under section 119A of the Data Protection Act 2018.
You have the same data subject rights as those for the EU listed above, except that references to the “GDPR” should be read as references to the “UK GDPR” and complaints should be filed with the UK supervisory authority, the Information Commissioner’s Office (https://ico.org.uk/).

- This section of the Privacy Notice applies solely to California residents. We adopt this Section to comply with the California Consumer Privacy Act of 2018 (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”). Any terms defined in the CCPA or CPRA have the same meaning when used in this Section.

Please note that if we collected information about you for a single one-time transaction and do not keep that information in the ordinary course of business, that information will not be retained for purposes of a request under this section. In addition, if we have de-identified or anonymized data about you, we are not required to re-identify or otherwise link your identity to that data if it is not otherwise maintained that way in our records.
You can also request that we correct or delete your Personal Information. There may be certain exceptions to our obligation to correct or delete your information such as if you have an existing account or transaction with us or if we have a legitimate business reason to keep your information.

- Right to Limit Use of Sensitive Personal Information

- Third Party Marketing (“Shine The Light Act”)
- California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us a list of what Personal Information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties.
- Exercising Your California Privacy Rights
- You or your authorized agent may make a request to access, correct, delete, opt-out of the sale of your Personal Information, or limit the use of your Sensitive Personal Information by contacting us using the information in the “Contact for Inquiries” section of the Privacy Policy
If you use an authorized agent to submit your request, we may require proof of the written authorization you have given. We also may require you to confirm your identity and your residency to obtain the information, and you are only entitled to make this request twice in a 12-month period. For emails, please include “California Privacy Rights” as the subject line. You must include your full name, email address, and attest to the fact that you are a California resident. We will acknowledge your request within 10 days and respond to your request within 45 days or let you know if we need additional time. - Opt-Out Preference Signals
